We use your personal information to help you find and, if you choose to do so, apply for health insurance and other products that may be of interest to you and your family. We only use and disclose your personal information in accordance with our privacy policy. Additionally, we use industry-leading technologies to ensure the security and confidentiality of the personal information you provide us. Throughout this policy, we refer to information that can identify you as a specific individual, such as your name, phone number, email address, Social Security number, or credit card number, as "personal information".
 

Further, personal information includes any information about your health or medical history that you may provide us in a health insurance application or any financial or other sensitive personal information that you may provide us in an application to obtain an advanced premium tax credit (or "subsidy") determination from the government. If you provide information directly to one of our partners or any other third party, then your information would be governed by such other party's privacy policy.
 

We do not disclose your personal information to third parties unless one of the following limited exceptions applies. Insurance Companies, Licensed Agents and Business Partners, HSA Trustees or Administrators, and Government-run Exchanges and Entities.
 

If you apply for an insurance product offered by us, then we will disclose your personal information to your chosen insurance company to process your application. If you submit a request for information or an application for an insurance product offered through an insurance agent, agency, or other business partners with whom we associate or contract, then we may disclose your personal information to that agent, agency, or business partner to process your request for information or application or to otherwise provide you with information about insurance products (including contacting you by telephone, email, or otherwise to discuss insurance products in which you may be interested). If you complete an enrollment form for a health savings account ("HSA") offered through an authorized HSA trustee or administrator with whom we have associated, then we may disclose your personal information to that trustee or administrator to enroll you in an HSA. If you complete an application with us that is processed through a government-run exchange or other government-run entity, we will disclose your personal information to that government-run exchange or entity. Please be assured that these partners are only allowed to use your personal information to process your requested quote, application, or enrollment form and are legally obligated to maintain strict confidentiality.

Employers, Affinity Groups, and Benefits Administrators or Consultants.
 

If you were referred to us by, or use our website or call center in connection with, a current or former employer, affinity group, or other organization with which you may be affiliated (or a benefits administrator or consultant associated with such employer, group or organization), we may disclose your personal information to such employer, group, organization, administrator and/or consultant. For example, we may inform such employer, group, organization, administrator and/or consultant whether or not you have enrolled in a plan. If you request to be contacted about any type of insurance product, request to be contacted by a licensed agent or other representative, request assistance with enrolling in any type of insurance product or make any other request for someone to contact you (such as by filling out an online request form), then our agents or representatives may contact you, or we may disclose your personal information to a third-party insurance agency, insurance agent, insurance company or other appropriate entity, so that such entity may contact you about any product in which you indicated interest or may assist you in enrolling in any such product. Any additional information that you subsequently choose to provide to any third-party entity will be governed by that entity's privacy policy.
 

Outside of these exceptions, we will not sell, trade or share your personal information with third parties.

Under our current process, you must create an account in connection with an application for a health insurance or other product offered on our website. You may also register with us through our Customer Care Center by providing certain personal or contact information (e.g., email address, phone number, gender, date of birth) to one of our customer service representatives.

If you apply for a health insurance or other product through our website, we may ask you to provide us with personal information and/or health information relating to you and any family member who will be included on your application. This information will be used by your chosen insurance company, agent, HSA trustee or administrator, or government-run exchange or entity to process your application. Additionally, we may ask you to provide us with your credit card, bank information and social security number, which will be used by your chosen insurance company or HSA Trustee or Administrator to process your application or collect any fees associated with your application or insurance premiums upon approval of your application. If you apply through us for government health insurance subsidies or for health insurance sold through a government-run exchange, we will ask you for personal information, including financial, tax filing and household information, that we will pass on to government-run sites and entities responsible for processing such subsidies and applications.

We may use your personal information to get in touch with you when necessary to process your application or to provide you with a quote. For example, emails will be sent to you throughout the application process to inform you of the status of your application and to seek additional information that is requested as part of the application. HealthCare Affairs. ("Agency", "we", "our" or "us") is committed to protecting the privacy of your health information. In conducting our business, we will create records regarding you and the services we provide to you. A federal law, the Health Insurance Portability and Accountability Act of 1996 (HIPAA), requires Agency to take reasonable steps to ensure the privacy of your "Protected Health Information" (as defined below) and to provide you with this Notice of Privacy Practices. We will abide by the terms of our Notice of Privacy Practices currently in effect. This notice applies to American Medical Association-sponsored health plans and certain other health plans.
 

This notice describes your rights concerning "Protected Health Information" ("PHI") about you. PHI is information that may identify you and that relates to (a) your past, present, or future physical or mental health or condition or (b) the past, present, or future payment for your health care.
 

It may be necessary to change the terms of this notice in the future. We reserve the right to make changes and to make the new notice effective for all PHI that we maintain about you, including PHI we created or maintained in the past. 1. Required Disclosures. Use and disclosure of your PHI may be required by the Secretary of the Department of Health and Human Services to investigate and/or determine Agency's compliance with HIPAA's privacy regulations.

 

2. Uses and Disclosures Related to Treatment, Payment, and Health Care Operations. Agency and its business associates may use or disclose PHI for activities related to treatment, payment, and health care operations. As described in the next section entitled "Your Privacy Rights", you have the right to request a restriction on the use and disclosure of your PHI for treatment, payment, or health care operations purposes.

Since we are not a health care provider, we do not engage in the treatment of individuals and, accordingly, we will not share your information for such purposes. Examples of activities related to payment include payment of health care claims or collection of premiums. Examples of activities related to health care operations include quality assessment and improvement, underwriting, audit services, legal services, data

aggregation, business planning and development, administrative activities related to compliance, customer services, fraud, and abuse prevention and detection, and complaint resolution.

 

3. Other Uses and Disclosures of Your PHI. In addition to the uses and disclosures described above, Agency may use or disclose PHI for the following purposes: for public health activities (for example, to alert public health authorities of public health risks to prevent or control disease, injury or disability or handle situations where a child is abused or neglected or for example, to notify the FDA of problems with a product regulated by the FDA, to notify a person who has been exposed to a communicable disease or may be at risk of spreading or contracting a disease or condition, or providing information to an employer when the employer can have the information for work-related reasons); for health oversight activities (for example, to assist in investigations relating to insurance fraud); for judicial and administrative proceedings (for example, in response to a subpoena or discovery request); for certain law enforcement purposes (for example, required reporting to certain courts or victims, to report a crime, or identify a suspect); for protection against serious harm (for example, to protect victims of abuse, neglect or domestic violence); for specialized government functions (for example, to assist in national security, military and intelligence activities); for certain government-approved research purposes (if certain conditions are met); for workers' compensation purposes (for example, when required by workers' compensation laws); to a coroner, medical examiner, or funeral director (to permit them to carry out their legal duties); in order to facilitate organ donations and transplants; when necessary to prevent or lessen a serious and imminent threat to health or safety; or when required to do so by federal, state, or local law.

 

4. Use and Disclosure to Family Members or Other Personal Representatives. We may disclose PHI to a family member, guardian, executor, administrator, or other person identified by you and authorized by law to act on your behalf with respect to health care. When disclosing information to such a person, we will take appropriate steps to verify the identity of such person.

 

5. Use and Disclosures to Plan Sponsor (Employer). We may disclose PHI to an employer-sponsor of a group health plan, if applicable, provided that any such plan sponsor certifies: (a) that the information provided will be maintained in a confidential manner and shall not be used for employment-related decisions or for other employees benefit determinations or in any other manner not permitted by law; and (b) that the plan documents contain provisions concerning restrictions on how the plan sponsor may use or further disclose PHI.

6. Use and Disclosure to Contact You Regarding Health-Related Benefits and Services. Agency or its business associates may contact you regarding health-related benefits and services that may be of interest to you.

 

7. Uses and Disclosures to Business Associates. We may disclose PHI to our business associates, such as information systems consultants, production vendors, and actuarial consultants, who perform services on our behalf. When we disclose information to a business associate, we will require the business associate to protect the privacy of your PHI through a written agreement with Agency.

8. Uses and Disclosures That Require Your Written Authorization. Your prior written authorization would be required before we may disclose PHI for marketing purposes, disclose PHI if Agency receives remuneration for distribution of the communication, or disclose psychotherapy notes. Other uses and disclosure of your PHI not described in this Notice of Privacy Practices will be made only with your written authorization unless otherwise permitted or required by law as described in this notice. You may revoke such authorization at any time, except to the extent Agency or its business associates or other entities have relied on such disclosure. Revocation will not affect any uses or disclosures made with your permission before it was revoked. Also, if you gave us permission to disclose your information in order to obtain insurance coverage, you may not revoke it if another law allows the insurer to contest a claim under the policy or the policy itself.

 

9. Genetic Information. To the extent applicable, we will not disclose any genetic information in our possession for underwriting purposes.

 

10. Other Applicable Law. In the event applicable law, other than HIPAA, prohibits or materially limits our uses and disclosures of PHI, as described above, we will restrict our uses or disclosures of PHI in accordance with the more stringent standard.

This Privacy Notice Statement (“Statement”) explains how HealthCare Affairs., (also referred to herein as “we” or “us”) may collect, use and disclose certain personally identifiable information (“PII”) in the course of assisting you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in qualified health plans (“QHPs”) through the Federally Facilitated Marketplace (“FFM” or “Marketplace”) or directly through the carrier, and/or applying for federal subsidies.

 

PII includes any information that can be used to distinguish or trace your identity, either alone or in combination with other personal or identifying information that is linked or linkable to you. Examples of PII include your name, address, phone number, Social Security Number, date and place of birth, and mother’s maiden name.

To whom and for what purposes PII may be disclosed;

We will take reasonable steps to ensure that any of your PII in our possession is complete, accurate, and up to date – to the extent necessary to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies – and has not been altered or destroyed in an unauthorized manner. We have implemented operational, administrative, technical, and physical safeguards and procedures, including privacy and security training programs for members of our workforce, to protect your PII and ensure its confidentiality, integrity, and availability, and prevent unauthorized or inappropriate access, use, or disclosure.

 

In accordance with our established privacy and security standards, which are publicly available upon request, you (or your duly authorized representative) have the right to a simple and timely means of accessing and obtaining your PII in a readable form and format, disputing the accuracy or integrity of your PII, and having erroneous information corrected, substituted or deleted. If the PII in question originated from another source, then you should contact the originating source for this purpose.

 

Legal Authority for Collection of PII

We have entered into an agreement with the Marketplace, under which we will comply with the Marketplace’s privacy and security standards established by the U.S. Department of Health and Human Services and the Centers for Medicare & Medicaid Services. We may collect, use, or disclose your PII if and to the extent required under applicable law. In all other instances, we may collect, use, or disclose your PII, in accordance with this Statement, to the extent necessary to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies.

 

Purpose of Collection of PII

The purpose of our collection of PII is to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies.

 

To Whom and for What Purpose PII May be Disclosed

We may disclose your PII to the Marketplace (or employees, agents, or sub‐contractors thereof), certain federal or state agencies, a health insurance issuer offering a QHP that you have selected (or such issuer’s employees, agents, or subcontractors), or any individual who is duly and legally authorized to act on your behalf in connection with your PII. This includes any individuals acting under an appropriate power of attorney or appointment that complies with applicable state and federal law. Your PII may be disclosed to the extent necessary for us to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies.

 

Authorized Uses and Disclosures of Collected PII

We may use and disclose PII if and to the extent reasonably necessary to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies. We will obtain your informed consent, which you may revoke at any time, for any other uses or disclosures of PII.

 

Whether Request to Collect PII is Voluntary or Mandatory under Applicable Law Our request collect your PII, for purposes of assisting you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies, is voluntary.

 

Effects of Nondisclosure of PII

If you choose not to provide the requested PII to us, then we may be unable to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies.
